A lawsuit filed in state court seeks an emergency order requiring Cobb County to overnight deliver approximately 2,900 absentee ballots that have not reached voters.

The complaint alleges that the Georgia voter portal incorrectly lists the ballots as issued. The filing identifies Fort Orange Press, a New York-based vendor hired to manage the mail-in process, as the cause of the delay.

Charlie Bailey, chair of the Democratic Party of Georgia, stated that the vendor issue could impact up to 10,000 residents across Cobb, DeKalb, and Gwinnett counties. He noted that voters in other Georgia counties did not appear to be affected by the same problem.

Cobb County Elections and Registration has posted schedules for scanning, tabulating, and canvassing election returns. The county office also advised voters who have not received mail to check their status via My Voter Page or contact the office at 770-528-2581 or ABM@cobbcounty.gov.

Voters who requested a mail ballot may vote in person after completing a cancellation process. Advance voting concludes on Friday, Oct. 30. Mailed ballots must physically arrive at the county by 7 p.m. on Election Day, Nov. 3. A postmark date alone will not satisfy the deadline.
