West Virginia Attorney General JB McCuskey must pause his investigation into two environmental organizations for two weeks. A federal judge issued the order Thursday, citing First Amendment concerns over the scope of the documents demanded by the state.

In September, McCuskey’s office subpoenaed the West Virginia Rivers Coalition and 350.Org. The legal orders requested ten years of internal records. These documents included details on public statements regarding climate and energy, internal deliberations, donation requests, and the identities of funders and their contribution amounts. The subpoenas also sought information on shared leadership with renewable energy entities and interactions with other advocacy groups on state energy permitting.

Judge Joseph Robert Goodwin of the United States District Court for the Southern District of West Virginia ruled that the investigative power was being used in violation of constitutional protections. He granted a request for an injunction filed by the two groups last week.

Goodwin wrote that the state cannot force citizens to account for their opinions or the people with whom they share them. He described the subpoenas as shockingly broad, noting that the organizations have engaged in protected advocacy speech rather than commercial activity. The judge stated that the demands chilled the groups’ exercise of their rights and deterred others from similar conduct.

The ruling specifically addressed the freedom of association and speech claims. The organizations had also argued that the subpoenas violated the Fourth and Fourteenth Amendments, but Goodwin did not address those issues in his order.

The fourteen day stay expires on November 12 unless extended. A separate order will schedule a hearing on the motion for a preliminary injunction. The state’s latest license plate features nine mysterious creatures, including the Mothman and the Flatwoods Monster, a detail that contrasts with the legal dispute over climate advocacy in the region.

The investigation targets many of the state’s leading environmental groups. McCuskey’s office had sought to understand the financial and operational ties between these nonprofits and broader energy advocacy networks in West Virginia.
